PLACING AN ORDER

I. |
By placing an order from Wide Open Throttle
Motorsports via Website, Email, Phone, Fax, all Instant Messengers, standard
mail, and forums, you agree to and accept all terms and conditions laid out
on this page. Furthermore, you acknowledge that you are 18 years and older
and agrees to all local, state, and federal laws of the use of such products
sold. |

Our website is hosted by Yahoo! Small
Business, so rest assured that your information is secure. Your information
is protected while in transit across the Internet with Secure Sockets Layer
(SSL) using 128-bit encryption, which complies with Visa security
requirements and is the highest level of encryption available in commercial
web browsers. |

III. |
All credit card orders must be shipped to the
billing address of the card, absolutely no exceptions! |
PAYMENT
|
I. |
We
currently accept Visa, Mastercard, American Express, and Discover Card. We
do not apply credit card surcharges on any retail order. To prevent fraud,
we require that all orders be shipped to the billing address of the card
holder. When an order is processed, your street number and zip code are
entered into our credit card terminal. If the address and zip code do not
match what your card issuing bank has on file, your order will be placed on
hold. You will be contacted by one of our customer service representatives
to either ask if your order can ship to the billing address or if you would
like to add a temporary shipping address. Adding a temporary shipping
address to your credit card can be done instantly, you simply need to call
the ‘800’ number on the back of your card and tell the representative that
you’d like to add another address to your file. |

II. |
Mailing
Payment: We accept verified funds such as Money Order or Cashier’s Checks as
an alternate form of payment. We do not accept personal checks. Please contact us first so
we can accurately quote you for the item(s) and shipping. We will provide our mailing address
at that time. |
|
III. |
Wire
Transfer: All wire transfers will have a $20 surcharge added to cover all
Wide Open Throttle Motorsports bank expenses. Please call for Wide Open
Throttle Motorsports banking information prior to ordering. |
|
IV. |
All
returned checks will be subject to a $25 fee. |
|
V. |
No sales
tax for customers outside the state of Arizona. 7.6% state sales tax
is automatically applied to any customer within the state of AZ. |
|
VI. |
We will
follow all collections for payment to the fullest extent by law. |
WARRANTY
|
I. |
All
products carry the manufacturer’s warranty only. If you have any questions
regarding the warranty of a specific part please contact Wide Open Throttle
Motorsports before making a purchase. |
|
II. |
Claims
may take as long as 60 days. Wide Open Throttle Motorsports will not issue
any credit until the Manufacturer receives, inspects and verifies that the
product is defective. ONLY then will credit be issued. Shipping is not
covered under warranty. All shipping charges are the responsibility of the
customer. All warranty claims must be issued a RMA number. Warranty will not
cover customer abuse, incorrect application, or negligence. |

III. |
All
merchandise is packed carefully before leaving the warehouse. Damaged
shipments must be checked while in the presence of the carrier. All claims
for damaged or loss goods must be made with the carrier. Keep all shipping
cartons and packaging materials for the carrier inspection. We will gladly
help with the claim by providing tracking numbers and any paperwork related
to the claim. |

IV. |
All hoods, hatches, bodykits, and most lip
kits ship via truck freight. When the receiver signs the delivery receipt,
the receiver is signing that all parts arrived in acceptable condition.
Please make sure you check the contents of the shipment before signing
anything from the freight company that is making the delivery. We are not
liable for any damages found after the receiver has signed for the shipment. |
RETURNS
|
I. |
All
returns must be made within 30 days of invoice date. All returns must be in
original container, unopened, like new, including all paperwork, and must be
in resalable condition. Absolutely no refunds on electronics, special order
items, turbo kits, intercooler kits, coilover kits, and wheels. All returns
are subject to a 25% restocking fee. |
|
II. |
All
shipping costs are the responsibility of the customer. The customer is
recommended to insure each product shipped back with the freight or shipping
company for the value of the replacement part (i.e. invoice price). |
|
III. |
All
returns must have an RMA (Returns Merchandise Authorization) number provided
by Wide Open Throttle Motorsports. All returns must have the original
invoice and RMA number written on
box before it is shipped back to us. |
|
IV. |
All
credit will be applied to the customer’s account within 5 business days of
receiving and inspecting the item at our location. |
|
V. |
Credit
will be applied in the way the initial payment was made. For example, if
paid via credit card, we will refund back to the original card. We cannot
credit any card besides the original card used. |
|
VI. |
Credit
will not be applied to any item that has been installed or that is not in
the condition as it was when shipped. |
BACKORDERS
|
I. |
Occasionally, a backorder will happen even with our
large inventory and ever growing distribution chains. Once in a while, the
demand for certain items may overwhelm the manufacturer's ability to keep us
supplied with adequate stock. In situations like this, we make every effort
to cross-reference the part to a comparable manufacturer's line. If
cross-referencing is not an option, and you have to wait for a part, we will
not bill you until that part is shipped to you. If the backordered item
happens to be part of a larger order that has already been shipped to you,
you will not incur any extra charges. |

II. |
Once backordered item(s) become available, you
will be billed and the item will then ship out. |
SPECIAL
ORDERS
|
I. |
Special
orders may require a deposit or full payment in advance. Once placed,
special order products are non-returnable and non-cancelable. NO EXCEPTIONS.
Special order items may include extra shipping charges. |
|
II. |
Special
orders may take weeks to months for delivery. These times can only be
estimated and due to production limitations or shipment capabilities we cannot guarantee delivery. Wide Open Throttle Motorsports will not be held
responsible for delays or further than estimated time for delivery. |
CANCELLATION
|
I. |
All
order cancellations must be made prior to shipment. Once an order has been
shipped we will not accept any cancellation. If the customer refuses the
shipment all return policies will take effect. |
|
II. |
Wholesale cancellations will be credited to the company if cancelled before
shipment or billing. |
PRODUCT LIABILITY
|
I. |
By
installing or using any purchased products, the customer is releasing Wide
Open Throttle Motorsports and all employees of Wide Open Throttle
Motorsports liable of cause. |
|
II. |
Most
items sold by Wide Open Throttle Motorsports are for off-road use only and
should not be used on public roads. It is the responsibility of the customer
to check local, state, and federal laws before placing an order.
|

III. |
Wide
Open Throttle Motorsports is not responsible for any damage caused by
installing or using sold products. Any claim to fault of product must be
made with manufacturer. Wide Open Throttle Motorsports will provide
assistance with paperwork on any part sold. |
|
IV. |
Wide Open Throttle Motorsports holds no responsibility either implied or
otherwise for mechanical, electrical or other failure when using aftermarket
performance products. |
SHIPPING
|
I. |
All
orders made prior to 3:00pm
MTN Standard time will be shipped the same day if item(s) are currently in
stock at our local facility. |
|
II. |
All
orders that are to be drop shipped must be allowed 1-2 business days for
processing. |
|
III. |
Shipments will not be released if credit card is not verified. Non
verification will result in a hold on the account until customer can be
reached and verified. |
|
IV. |
Orders
will only be shipped to verified address on the credit card. If the shipping
address is not listed on the credit card we cannot ship to address unless
prior arrangements have been made. |
| V. |
Shipping to Alaska, Hawaii, and Puerto Rico is
extra. When you place your order, the shipping you see on your invoice
is for customers within the 48 states. You will be notified after you
submit your order and provided a correct shipping total based on your zip
code. |

VI. |
Our online ordering system only shows a ground shipping
option. If you need faster shipping, we
will gladly accommodate most priority shipping requirements in the
continental US, such as Next Day, 2-Day, and 3-Day whenever possible.
Priority shipping will be extra and is not included in the standard ground
shipping option. |

VII. |
Free Shipping promotions apply only to the
48 contiguous states. |
INTERNATIONAL
CUSTOMERS
|
I. |
At this
time, we are no longer accepting orders from outside the US.
This includes Canada and Mexico. |
TYPOGRAPHICAL ERROR
|
I. |
In the
event of incorrect pricing, incorrect information supplied by the
distributor, importer, or manufacturer, or typographical errors, Wide Open
Throttle Motorsports reserves the right to refuse or cancel any order placed
for item(s) incorrectly listed. In the event that an item(s) purchased was
incorrectly priced, you will be contacted before shipment. |
LABOR FEES
|
I. |
Customer
agrees to release Wide Open Throttle Motorsports of all labor liability. We
do not reimburse labor charges for removing, replacing, or installing any
product due to failure of product. It is the responsibility of the customer
for any and all labor costs. |
